Commitment to Your Privacy
The Information WOTV Collects
WOTV gathers several types of information about Site’s users:
Voluntary Information Collection
When using the Site, you may voluntarily provide to WOTV what is generally called “personally identifiable” information (such as your name, nationality, gender, date of birth, email address, occupation, employer, postal mailing address, home/mobile telephone number, credit card number, card verification value, and billing information), depending on what features and functionality of the Site you use and access. However, you are not required to provide any personally identifiable information unless you choose to access certain features of the Site that require such information. For instance, we ask users for certain personally identifiable information when you register to make comments on the Site. This personally identifiable information would include: name, date of birth and email address. In addition, registered users may create a user profile on the Site that also requires submission of personally identifiable information, such as a logon ID. Finally, users may make purchases or online donations on the Site, and such purchases require additional personally identifiable information such as the user’s credit card and billing information.
Usage Tracking and “Automatically Collected” Information
When you access the Site or open one of our emails, WOTV may automatically record certain information from your system by using different types of tracking technology. This “automatically collected” information may include IP addresses, a unique user ID, the content and the pages that you access on the Site, and the dates and times that you visit the Site. WOTV gathers this non-personal information through aggregated tracking information derived mainly by tallying page views throughout the Site. However, we do not correlate this information with the personal information of individual users.
THE WAY WOTV USES INFORMATION
WOTV uses the information that you provide or that we collect to operate, maintain, enhance, and provide the various features and services found on the Site, as well as to track user-generated content and users to the extent necessary to comply as a service provider with the Digital Millennium Copyright Act and other applicable laws.
More specifically, we use the personal information about you stored in our member database in various ways:
The personal information collected allows WOTV to facilitate and track online donations to WOTV;
The personal information collected allows WOTV to video and film submissions to populate the online exhibition;
The personal information collected allows WOTV to acknowledge receipt of your payments for tax purposes and to help prevent fraudulent transactions;
Furthermore, we may use your email address, without further consent, for administrative purposes such as notifying you of major Site updates, future exhibitions, other WOTV events, for customer service purposes, to address intellectual property infringement, rights of privacy, or defamation issues related to submitted content, and to provide security related notices. For some of these communications, you may choose to opt out of receiving them.
WOTV uses aggregate information about how our Site is used (without specific identification to any particular user) to improve Site flow and usability, tailor our content to Site users’ needs, and make it more responsive to our users’ preferences. In addition, we track click-through information (e.g., IP addresses) to our site from the reports and emails sent to customers in order to gauge the effectiveness of our marketing campaigns and to discourage fraudulent use. Again, however, we do not correlate this information with the personal information of individual users.
WOTV may use “automatically collected” information and “cookies” information to: (a) remember your information so that you will not have to re-enter it during your visit or the next time you access the Site; (b) provide customized third-party advertisements, content and information; (c) monitor and report on the effectiveness of third-party marketing campaigns; (d) monitor and report aggregate usage metrics such as total number of visitors and pages accessed; and (e) track your entries, submissions, and status in any promotions or other activities.
Consistent with the federal Children’s Online Privacy Protection Act of 1998 (COPPA), we will never knowingly collect or maintain personally identifiable information on the Site from anyone under the age of 13, and no part of the Site is directed to persons under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE SITE AT ANY TIME OR IN ANY MANNER. Any person who provides their personal information to the WOTV through this Site represents that they are 13 years of age or older. If WOTV learns that personally identifiable information of persons under the age of 13 has been collected on the Site without verifiable parental consent, then WOTV will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the age of 13 has obtained a Site account, then please contact WOTV at firstname.lastname@example.org and request that WOTV delete that child’s personal information from its systems.
WOTV TRANSFER AND INFORMATION SHARING POLICY
WOTV adheres to the principle that all information created by, or on behalf of, an organization is the sole property of that organization, and WOTV will not disclose, share, or transfer such information except on behalf of the organization.
WOTV may disclose automatically collected and other aggregate non-personally-identifiable information with interested third parties to assist such parties in understanding the usage, viewing, and demographic patterns for certain programs, content, services, advertisements, promotions, and/or functionality on the Site.
WOTV may disclose user information if required to do so by law or in the good-faith belief that such action is necessary to comply with state or federal laws (such as U.S. copyright or trademark law) or respond to a court order, subpoena, judicial or other government requirement, or warrant in the manner requested by the requesting entity. In some cases, we may make such disclosures without first providing notice to users.
WOTV also reserves the right to disclose user information that we believe, in good faith, is appropriate or necessary to take precautions against liability; protect WOTV from fraudulent, abusive, or unlawful uses; is appropriate to carry out a user’s request; to initiate, render, bill, and collect for amounts owed to WOTV; to investigate and defend ourselves against any third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Site; or to protect the rights, property, or personal safety of WOTV, ours users, or others.
Merger or Bankruptcy
If WOTV should ever file for bankruptcy or have its assets sold to or merge with another entity, information WOTV receives from you from this Site is a WOTV asset and may be transferred.
You may, of course, decline to share your personally identifiable information with WOTV, in which case WOTV will not be able to provide to you some of the features and functionality found on the Site. If you do not want to receive additional information from WOTV, please uncheck the appropriate box or select “No” at the point at which WOTV requests the information. You may update, correct, or delete your user information and preferences at any time by logging into the community page of the Site with your user name and password. Furthermore, you may at any time remove your name and contact information from any mailing lists that WOTV sponsors by notifying WOTV at email@example.com.
To protect your privacy and security, we take reasonable steps to verify your identity before granting you account access or making corrections to your information. YOU ARE RESPONSIBLE FOR MAINTAINING THE SECRECY OF YOUR UNIQUE PASSWORD AND ACCOUNT INFORMATION AT ALL TIMES.
WOTV does not provide your personally identifiable information to these third-party ad servers or ad networks without your consent. However, please note that if an advertiser asks WOTV to show an advertisement to a certain audience or audience segment and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience that they were trying to reach.
INTERNATIONAL VISITORS AND CUSTOMERS
The Site is hosted in the United States. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal data to the United States, which does not have the same data protection laws as the EU and other areas of the world, and by providing your personal data you consent to:
the transfer of your personal data to the United States as indicated above.
WOTV uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. However, no data transmissions over the Internet can be guaranteed to be 100 percent secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. Once we receive your transmission, we make commercially reasonable efforts to ensure security on our systems. We use secure server software (SSL) and firewalls to protect your information from unauthorized access, disclosure, alteration, or destruction. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of such firewalls and secure server software or any other physical, technical, or managerial safeguards that we implement.
If WOTV learns of a security systems breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using this Site or providing personal information to us you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of this Site. WOTV may post a notice on our Site if a security breach occurs. If this happens, you will need a web browser enabling you to view WOTV’s Site. WOTV may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.
